If you were unaware, the 31-year-old Grammy winner and her co-writers were sued in September amid allegations that the chart-topping song copied elements of Bruno Mars\u2018 hit \u201cWhen I Was Your Man.\u201d Bruno was not involved in the lawsuit, which was filed by a company called Tempo Music Investments. They purchased a portion of the the song\u2019s copyright from co-writer, Philip Lawrence.<\/p>\n<p>In newly filed documents, Miley\u2018s team addressed the suit and explained why it did not hold up in court. According to court documents obtained by Billboard, Miley\u2018s team argued that the suit could not proceed since Bruno and two of his co-writers were not involved in it. \u201cPlaintiff unambiguously [says] that it obtained its claimed rights in the \u2018When I Was Your Man\u2019 copyright from only one of that musical composition\u2019s four co-authors,\u201d they wrote. \u201cThat is a fatal and incurable defect in plaintiff\u2019s claim.\u201d They argued that Tempo only had \u201cnon-exclusive rights\u201d to Bruno\u2018s song, which isn\u2019t enough to support the lawsuit \u201cwithout the consent of the other owners.\u201d Additionally, the team said that there were \u201cstriking differences in melody, chords, other musical elements, and words.\u201d Tempo\u2019s legal team replied, claiming that the argument was a \u201cbogus\u201d argument.<\/p>\n<p>\u201cWe\u2019re not an assignee; we\u2019re the owner of the copyright.
